Position Summary:

Director of Compliance & Ethics will assist the Chief Compliance Officer with the development, implementation, strategy, management, and oversight of the organization's global Compliance & Ethics Program. This individual is responsible for leading the operational efforts of the Compliance & Ethics Program which include implementing and maintaining programs and infrastructure designed to ensure that NeoGenomics carries out its business objectives in accordance to global fraud, bribery and corruption laws, and NeoGenomics' Code of Conduct.

Responsibilities:

  • Assist in designing, planning, implementing and executing of a comprehensive Compliance & Ethics program and strategy.
  • Coordinate team operations and functions including Risk, Audit, Policy and Procedures, Training and Communications, and Incident Management.
  • Advise internal partners of potential compliance risk areas, in particular, Sales and Marketing personnel.
  • Manage, develop and mentor Compliance & Ethics managers and staff both onsite and at remote locations to ensure completion of annual work plans and goals, and the furthering of the team's skills and career ambitions.
  • Collaborate with and support leadership (e.g., Legal, Sales, Marketing, Operations and Human Resources) on compliance matters to ensure adherence with laws, regulations, standards, guidelines, and NEO's Code of Conduct.
  • Chair and facilitate regular meetings of the Organizational Compliance Committee to engage cross-functional Compliance & Ethics ownership and accountability.
  • Engage in annual compliance risk assessment, manage the risk register, and direct the development of compliance work and audit plans and individual team member goals.
  • Perform regular training of personnel on compliance and ethics topics and company policies, while having continuous improvement for the Compliance & Ethics department internal operations.
  • Conduct Third Party Intermediary (e.g., distributors, sales agents, etc.) due diligence, investigations, and other vetting prior to contracting and onboarding with NeoGenomics in accordance with the Foreign Corrupt Practices Act and other global anti-corruption laws.
  • Develop and implement a program to support global transparency reporting requirements (e.g., U.S. Physician Payment Sunshine Act, Loi Bertrand)
  • Continually acquire and update personal knowledge to accommodate changes to Neo's regulatory environment and needs.

Education:

Bachelor's degree (preferably in a healthcare related field). Master's or Healthcare Law degree preferred.

Experience:

Minimum of 10 years' experience working with global and domestic anti-kickback, anti-corruption, transparency reporting, and data privacy rules and regulations. Proven experience in leading all aspects of compliance and ethics programs related to global sales and marketing activities is required.

Qualification Requirements:

  • Minimum of 10 years demonstrated experience executing and managing compliance programs in the global healthcare, pharma, medical device, or biotechnology industries (e.g., FCPA, UK Bribery Act, U.S. Anti-kickback Statute, U.S. Sunshine Act, etc.).
  • Solid understanding of the healthcare delivery system as it relates to government agencies and the enforcement of associated global, federal and state regulations.
  • Expert knowledge in the effective execution of all elements of an effective compliance program.
  • Ability to build positive relationships to foster an advisory or collaborative approach to proactive compliance activities.
  • Strong research, analytical, and problem-solving skills.
  • Ability to prioritize, projects, and team members, as well as adapt to changing business needs.
  • Strong communication skills to facilitate interaction with representatives across the organization, including executives, department directors/managers, Legal Department, staff, and external organizations and agencies.
  • Ability to maintain the confidentiality of sensitive or private matters while performing job duties and interacting with colleagues.
  • Ability to function in team projects and fill various roles such as team member, facilitator, or leader as needed.
  • High proficiency in Microsoft Office Programs is vital to complete work requirements.

Certificate Compliance Requirements:

Certification in Compliance and Ethics (CCEP), Healthcare Compliance (CHC), or similar highly preferred.

Travel Required:

Travel will be less than 25%. Some overnight travel may be required.
